Abstract
The action of repetition is a legal remedy that aims to collect a debt owed by a third party who has paid an obligation that does not correspond to him. In public administrative law, it is a legal mechanism through which the State and the authorities of public institutions can recover the resources that, by way of compensation, they paid to the victims of the violation of their rights. In this context, the objective of this research is to critically analyze the characteristics of the action of repetition in order to determine whether it is effective to recover the amounts paid by the State. The unit of analysis is located in the province of Chimborazo, specifically in the Public Institutions of the city of Riobamba; the researcher assumes a qualitative approach, for the study of the legal problem will be applied the methods, inductive, legal-analytical, legal comparative and case study; by the objectives and complexity is pure type, dogmatic and legal descriptive; non-experimental design. The study population is constituted by lawyers specialized in administrative law graduated from the National University of Chimborazo and authorities of public institutions of the city of Riobamba, in a total of two, to whom a questionnaire of eight questions will be applied; The results are intended to test the hypothesis and conclude by pointing out that the action of repetition shows several obstacles in the recovery of resources spent by the State for reparation, procedural in nature, due to the coexistence of several regulations governing this figure, and cultural, due to the entrenched administrative practice in which it is chosen to limit the payment of compensation to the public treasury.
