Abstract
Informed consent constitutes the ethical and legal cornerstone of modern medicine, fostering patient autonomy. In general surgery, it is essential when performing invasive procedures. The problem lies in its current distortion, being reduced to the hurried signing of generic forms, which violates rights and generates legal uncertainty for surgeons. The objective is to determine the criminal typicality arising from the absence of informed consent in general surgery procedures. This qualitative and documentary research analyzed the impact of consent on medical criminal liability. The results demonstrate that a valid document operates as a criminal justification ground under the victim's assumption of risk, excluding liability if a typical complication ensues. Its omission constitutes a violation of the objective duty of care, transforming surgery into a punishable technical assault. In conclusion, informed consent is the most effective legal shield for the surgeon and ensures medical prudence.
