Abstract
Medical conscientious objection constitutes an expression of healthcare professionals’ right to act in accordance with their ethical principles and personal convictions. However, its exercise may give rise to conflicts when it affects the continuity of care for terminal cancer patients. The aim of this study was to analyze the impact of medical conscientious objection on the protection of fundamental rights, including the right to health, human dignity, personal autonomy, and timely access to palliative care within the Ecuadorian healthcare system. A qualitative study was conducted based on the analysis of legislation, doctrine, case law, and specialized literature, employing hermeneutic-legal, documentary, and content analysis methods. The findings revealed that conscientious objection is not an absolute right and that its exercise must be accompanied by mechanisms that ensure continuity of care and the effective protection of the rights of terminal patients.
