Abstract
In the field of Administrative Law, the purpose of the administrative sanctioning procedure is to correct misconduct committed by public servants. It is essential that in these procedures the basic guarantees of due process, recognized both in international instruments and in the Ecuadorian Constitution, are respected. Article 76.3 of the Constitution of the Republic of Ecuador establishes typicality as one of the essential guarantees of due process. This guarantee implies the application of a specific procedure to the specific case, based on precepts and procedural rules pre-established in the legal system. The objective of the study is to develop a legal, doctrinal and critical study regarding the violations of due process in disciplinary proceedings brought against judges for gross negligence in the Ecuadorian context. Following this, the theoretical and doctrinal axes that support manifest negligence will be based on a literature review analysis. Similarly, the status of current legal regulations regarding gross negligence and sanctioning processes will be diagnosed. In this way, it will be possible to describe the processing of disciplinary proceedings against judges by the Judiciary Council. Finally, the findings obtained from the processes of interpretation of the legal documents analyzed will be analyzed through the method of triangulation of sources. Three constitutional rulings that have analyzed this problem from different perspectives will be analyzed.
